Last updated: September 28, 2026 These terms are the agreement between you and ELTON SERVICES LLC for your use of CHANNEL Messenger. They are written to be read, and to say what is actually true about the app rather than to reserve every right a lawyer could think of. Where something is a real limitation, it is stated as one. Where we cannot promise something, we say we cannot rather than burying it.
The Privacy Policy describes what the app collects and what it does not, and is part of this agreement.
CHANNEL Messenger is published by ELTON SERVICES LLC, a Florida limited liability company, document number L26000469327. In these terms, “we” and “us” mean that company, and “the app” means CHANNEL Messenger on any platform.
You bought the app from Apple or Google, not from us. They are the seller. That matters for refunds and for your statutory rights, and §9 says how.
CHANNEL is a messenger for people who know each other, one to one or in a group. Messages are end-to-end encrypted. When your phone and the other person’s are close enough for a direct radio connection, a message goes from one to the other with no server involved at all. When they are not, the message can be carried by an internet mailbox that holds ciphertext it cannot read.
There is no account, no directory, no feed and no public profile. You add somebody by pairing with them, or by reaching an address they have proved is theirs.
Everything on this page describes the app as it is. The date at the top says when that was last checked.
This is the section most likely to matter to you, so it is deliberately blunt.
We do not guarantee that any message will be delivered, or delivered at any particular time. The app tries hard: it queues what it cannot send, retries, resumes interrupted transfers, and uses whichever route is available. But delivery depends on radios, on the other person’s phone being reachable, on networks we do not run, and on operating systems that decide for themselves when an app in the background may do anything. Some of those we can improve. None of them we control.
Do not rely on CHANNEL for an emergency. It cannot call emergency services, and a message that has not arrived looks the same as one that has not been read. If a message must get through, use something with a delivery guarantee, and confirm by another means.
The mailbox is not storage. A message waiting there is deleted the moment the recipient’s device confirms it, and one nobody ever collects expires — you choose after how long, up to a hard ceiling of 30 days. Nothing is kept beyond that, for anyone, including you. The app is not a place to leave something for later.
Your identity in CHANNEL is a cryptographic key on your device. We never hold it and cannot reissue it.
So: if you lose the device without a backup file, that identity is gone, and the people you had paired with will need to pair with you again. If you set an app code and forget it, we cannot reset it. If you make a backup and lose its passphrase, the file is unreadable — by you, by us, and by anybody else. These are consequences of the design rather than oversights, and they are the same property that makes the rest of the app’s claims true.
You are responsible for keeping your device and its passcode secure, and for the consequences of anything sent from it.
Do not use CHANNEL to harm people: to harass or threaten somebody, to defraud them, or to attack the app, the mailbox server, or anybody else’s device. What the law allows differs from one country to the next, and following the law where you are is your responsibility.
Do not use CHANNEL to send, request or share sexual material involving children, or to exploit a child in any way.
We cannot see what you send, and we do not monitor it. When we learn of child sexual abuse material, we report it to the National Center for Missing & Exploited Children, as US law requires, and we may remove anything we hold that is involved, such as a handle.
If somebody sends you such material, do not forward it to anyone, including us. Report it at report.cybertip.org or to the police where you are, then delete it and block the sender.
We cannot detect a breach of this section by looking at your messages. What we can do is decline to deal with you and respond to valid legal process from US authorities with what we actually hold — which the Privacy Policy describes, and which does not include your messages, your contacts or who is in your groups. The practical enforcement against somebody misusing the app is in the hands of the person receiving the messages: block them, delete the contact, and report them to the police if a crime has been committed.
Do not attempt to decompile, modify or redistribute the app, or to circumvent its purchase.
What you write and send is yours. We claim no licence to it of any kind, which is straightforward for us to say because we never have it: it is encrypted to the recipient before it leaves your device.
The app itself, its name and its design are ours and are licensed to you for personal use, not sold.
The app can offer AI features, and there are two quite different things behind that word.
On an iPhone that supports Apple Intelligence, the answer is computed on the phone itself. Nothing leaves the device, there is no account, and there is nothing here for anyone to agree about.
Otherwise you add an account of your own with a provider such as OpenAI, Anthropic or xAI. That account is yours. We are not a party to it, we do not resell it, and we add nothing to what it costs you. Their agreement and their prices govern what happens at their end, and we cannot see, change or refund any of it.
Three things follow, and they are worth reading even though they are short.
We may change the app, and we may change these terms. If a change materially reduces what you get, we will say so plainly and change the date at the top; continuing to use the app after that is your acceptance.
If we ever stop running the mailbox server, direct phone-to-phone delivery keeps working, because it never depended on us. Internet delivery would stop. We will give notice in the app before shutting the mailbox down, and we will not pretend a shutdown is a feature.
You bought this app from Apple or Google. Refunds are theirs to give, under their policies, and asking them is the right route.
Nothing in these terms removes a right you have by law. If you are a consumer in the European Union or the United Kingdom, you have rights about goods and digital content that cannot be excluded by an agreement like this one — including that what you bought must match how it was described and must work with reasonable skill and care — and those rights apply whatever the rest of this document says. The same is true anywhere else that gives consumers non-excludable rights.
Subject to that: the app is provided as it is, we do not promise it will be uninterrupted or error-free, and to the extent the law allows, our liability to you is limited to what you paid for the app. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
Do not use CHANNEL if you are under 13, or under the minimum age in your country if that is higher. There is no account and no age verification, which means this is a rule we ask you to follow rather than one we can enforce, and saying otherwise would be untrue.
These terms are governed by the law of the State of Florida, USA, and the courts there, except where the law of the country you live in gives you the right to bring a claim locally or to rely on your own country’s consumer law — in which case that right stands.
